Referral Program Terms & Conditions

YYC Homecare Referral Program – Terms & Conditions
Effective date: 3/08/2025

Important: These Terms & Conditions (“Terms”) govern YYC Homecare’s Referral Program (the “Program”). By participating, you agree to be bound by these Terms. YYC Homecare may amend, suspend, or terminate the Program at any time with or without notice, subject to applicable law.

1. Definitions

  • “YYC Homecare” / “we” / “us” / “our” means YYC Homecare Services Inc. (or the applicable operating entity).

  • “Referrer” means an individual who submits a referral under this Program.

  • “Referred Client” means a new client who is referred by a Referrer, is not currently (and has not

    been within the last 12 months) a client of YYC Homecare, and who meets all eligibility criteria

    below.

  • “Successful Sign-On” means the Referred Client has (a) completed YYC Homecare’s intake

    process, (b) signed the service agreement (or equivalent consent documents), and (c) scheduled

    their first visit or care shift.

  • “Reward” refers to the gift card(s) or service credit(s) issued to a Referrer and/or Referred Client

    under the Program.

    2. Eligibility to Participate

  1. The Program is open only to natural persons who are residents of Canada and at least the age of majority in their province or territory.

  2. Employees, contractors, or agents of YYC Homecare (and members of their immediate household) are not eligible to receive Referrer Rewards. They may, however, provide referrals in the course of their duties without compensation.

  3. Health professionals and individuals working in positions where referrals could contravene ethical or regulatory standards (e.g., physicians, nurses, hospital discharge planners) are not eligible for Rewards.

  4. Corporations, partnerships, and other business entities are excluded unless expressly authorized in writing by YYC Homecare.

3. How to Refer

  1. Referrers must submit referrals through YYC Homecare’s official referral form or another channel expressly authorized by YYC Homecare, providing:

  2. Referrer’s full name and contact information.

  1. Referred Client’s full name and contact information, with consent for YYC Homecare to contact them.

  2. Referrals without sufficient information, or without the Referred Client’s consent, will be deemed invalid.

4. Reward Structure (“$100 to $500”)
YYC Homecare will issue a Reward once a Referred Client achieves Successful Sign-On. No minimum

invoice or spend is required.

4.1 Referrer Rewards
The Referrer will receive a Reward with a minimum value of $100 CAD and a maximum value of $500

CAD, in the form of either: – a digital gift card, or – YYC Homecare service hours.
The exact Reward amount and format will be determined solely by YYC Homecare, based on the client

referred and any active promotions.

4.2 Limits

  • Annual cap: YYC Homecare may impose an annual maximum Reward amount per Referrer (e.g., $1,500 per calendar year). See Section 10 for modifications.

  • Only one Referrer is eligible for a Reward per Referred Client. If multiple Referrers claim the same client, YYC Homecare will issue the Reward to the first valid referral received.

    5. Reward Fulfilment

  1. Rewards will be issued within 30 days after the Referred Client achieves Successful Sign-On and YYC Homecare verifies eligibility.

  2. Gift cards will be delivered electronically via email (or another mutually agreed-upon method). Service credits will be applied to the Referrer’s or nominee’s next invoice.

  3. Gift cards are subject to the issuer’s terms (e.g., non-transferability, no cash redemption). YYC Homecare is not responsible for lost, stolen, or expired cards.

  4. YYC Homecare reserves the right to substitute a Reward of equal or greater value.

6. Claw-back & Fraud Prevention

  1. YYC Homecare may revoke or reclaim any Reward if:

  2. The Referred Client cancels their service agreement or fails to commence care within 30 days of

    Successful Sign-On; or

  3. YYC Homecare determines, in its sole discretion, that the referral involved fraud,

    misrepresentation, or breach of these Terms.

  4. YYC Homecare may audit participation and require reasonable cooperation from Referrers to

    confirm eligibility.

     

7. Taxes & Reporting

  1. Referrers are solely responsible for any taxes, duties, or fees resulting from receiving a Reward. YYC Homecare will not issue tax forms for Rewards unless required by law.

  2. Rewards provided to employees of YYC Homecare (if ever permitted) may be considered taxable benefits and reported as required by applicable law.

8. Privacy & Consent

  1. By participating, the Referrer confirms that they have obtained the Referred Client’s permission to share their personal information with YYC Homecare for the purposes of the Program.

  2. YYC Homecare will collect, use, and disclose personal information in accordance with its Privacy Policy and applicable privacy legislation (including Alberta’s Personal Information Protection Act). Participants may request access to or correction of their personal information.

  3. For commercial electronic messages (emails, SMS), YYC Homecare will obtain required consent or rely on an applicable exemption as per Canada’s Anti-Spam Legislation. An unsubscribe mechanism will be provided in all electronic marketing.

9. Communications & Unsubscribe

  1. By providing contact information, Referrers and Referred Clients may receive Program-related updates (e.g., eligibility status, Reward notices).

  2. Marketing emails or texts will include an unsubscribe link. Unsubscribing from marketing messages will not affect transactional messages necessary to administer Rewards.

10. Program Changes & Termination

  1. YYC Homecare may change Reward amounts, tier thresholds, eligibility criteria, or other Terms at any time. Any change will apply to referrals submitted after the effective date of the change, unless otherwise stated.

  2. YYC Homecare may terminate the Program at any time. If terminated, valid referrals received prior to termination will be honoured if tier conditions are met within 90 days, unless otherwise required by law.

11. Representations & Warranties

  1. YYC Homecare makes no warranties of any kind regarding the Rewards, which are provided “as is” and subject to third-party terms.

  2. YYC Homecare is not responsible for delays, failure of performance, or technical issues beyond its control.

12. Limitation of Liability

To the maximum extent permitted by law, YYC Homecare, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to the Program, even if advised of the possibility of such damages. YYC Homecare’s total liability for any claim related to the Program shall not exceed the value of the Reward at issue.

13. Disqualification

YYC Homecare reserves the right to disqualify any Referrer or Referred Client who, in its sole discretion, violates these Terms, attempts to manipulate the Program, or acts in a deceptive, fraudulent, or harmful manner.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and the laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in Calgary, Alberta, unless both parties agree to an alternative dispute resolution method.
